What Is the FTCLDF?

The Farm-to-Consumer Legal Defense Fund is a nonprofit organization that provides legal support and advocacy for small farms and the consumers who buy directly from them. Founded in 2007, they've defended farmers across the country against regulatory overreach, USDA investigations, state health department actions, and more.

Their focus is specifically on direct farm-to-consumer sales — raw milk, herdshares, meat, eggs, and other farm products sold directly to customers. In other words, exactly what most MilkShelf farmers do every week.

💡 Good to Know

Membership fees are tiered based on your farm's gross sales. Many small raw milk farms qualify for the lowest tier, making this one of the most affordable protections you can put in place.

Why It Matters for Raw Milk Farms

Raw milk is legal in most states, but the regulations vary widely — and enforcement can be unpredictable. A single complaint to a health department, a question about your herdshare agreement, or an inspection that goes sideways can quickly turn into a legal situation that costs thousands of dollars out of pocket.

Most small farms don't have an attorney on retainer. Most don't have the time or resources to navigate a regulatory challenge on their own. FTCLDF fills that gap — they've seen these situations before and they know how to handle them.

Herdshare Agreements

If you operate a herdshare program, having a solid legal agreement between you and your shareholders isn't just good practice — in many states it's what makes the arrangement legal in the first place. FTCLDF has model herdshare agreements and can help you understand whether yours holds up if challenged.

State Law Changes

Raw milk laws change. States that allowed direct farm sales have tightened restrictions; others have loosened them. FTCLDF tracks these changes and advocates on behalf of farmers when legislation is moving. As a member, you're part of that advocacy effort.

How to Join

Membership is straightforward. Visit farmtoconsumer.org/membership to see current membership tiers and sign up. Most small raw milk farms will fall into the individual or small farm tier.

We recommend signing up before you need it — not after a problem arises. Like any insurance, the time to get coverage is when everything is going well.

The Bottom Line

You've put enormous work into building your farm and your customer relationships. The FTCLDF is one of the most practical and affordable ways to protect what you've built. For the cost of a few jars of milk a month, you get legal backup from people who understand exactly what you do and why it matters.

If you have questions about FTCLDF membership or herdshare agreements, their team is genuinely helpful — don't hesitate to reach out to them directly at farmtoconsumer.org.
